A Research on Some User Rights and Benefits in Telecommunication Area

In the subscriber contracts that supply ace and/or communication to the telecommunic on networks must have at least the regu ments that lie below.

  • details of tariff and prices

? length of the contract, renewing conditions services and the contract and the conditions for br, ging it to a close.
? repayment and compensation arrangements tl will be made in a condition such as not meeting I service quality that is mentioned by the contract

These arrangements can be enlarged into a form, that will include the last users than the consumers.1 the contracts has been constructed between consumers and service suppliers that supply electron communication than the operators that supply acces and communication to public phone network agm the conditions that lie above must be supplied. In other words, in the contracts that are made betwe~ consumers and operators that supply electronic cod munication services, the 5 conditions that lie above must take place.
After declaration of an advise on changes in tn contracts, the subscribers can rescind without any payment or sanction.If the subscribers don’t accept the probable changes over the contract, they are warned ,by reminding also rescinding rights without anj payments, with a former announcement on the guestionned contract changes. It is a must to supply the transparent and curren information, which is concerned to the use of phonl services that is open to public and the supplied price and tariffs, standard conditions applied for access to these services, for the information of consumers and the last users. Again it is concerned with these infor­mation will be published by whom and in which style. In accordance, for national organizing authori­ties, consumers and the last users, he decides what kind of knowledge will be used by the service supplier operators, on his own. he information that will be published:
>> Name and addresses of the operators.
>> Supplied phone services that are open to public.
? The scope of the phone services that are open to pub­lic(description of telephone services that are open to public and subscriber prices and periodic rent prices, such as operator servi­ces guide services optional telephone blocakade, detailed receipt)
>> All use prices, standard tariffs that include access, too.
? The supplied reduction, compensation and repayment deta-
ils.
>>Recommended control services.
>>Standard contract conditions .
>>Conflict resolution mechanism
? Information for rights concerning services.
National organizing authorities must encourage information presentation service for consumers and last users to let them ma­ke an independent evaluation between using cost options.
National organizing authorities must supply the presentation of enough, comparable and current information about the quality of services of the managements that supply electronic communi­cation services, after taking the views of the related sides. Also these information must be tranferred to the national organizing authority, when it is demanded.
Also, national organizing authorities can stipulate definite qu­ality parameters that are related to service that will be supplied to public by operators near various arrangements about the content, shape and type of probable published information related to qu­ality of the service. It’ s aimed to supply easy comparable and comprehensive information for consumers and the last users, with these arrangement.
The subscribers of telephone services that are open to public have the right of taking place in guide services that are open to public. The managements that supply numbers to the subscribers have to explain the public all demanded information in a compro­mised format equal, honest, objective and in expense based con­ditions for guide services that are open to public.
Also all last users that are supplied for access to public telep­hone networks can benefit from operator and guide help. For ins­tance European Community services bring an obligation not to li­mit the use of its own citizens, the direct access to guide services also in other states.
European Union member states must provide a free single Eu­ropean emergent call number 112′ s presentation to all last users including last users of redeemable telephone services, near exis­ting emergent call numbers of each member state, on its own. In this direction, a unique emergent call number must be constructed in Turkey. Near construction of a unique European emergent call number ,the obligation for arranging this service in a reasonable and well working way has been given to the member states. For this aim, efficient reply and the most suitable way to discuss when this number is called, is left to member states. Also about the emergent call number, it has been arranged that the managements that supply telephone network that is open to public also will sup­ply the service to determine the place of the calling person, in an extent that the tecnique oppurtunities let. However, furthermore special arrangements can be made between member states for te­lephone access or this type of existing arrangaments can go on. In these type of situations related last users to these special arrange­ments must be informed and notified about the mentioned arran­gements completely. The European Union member states must supply another member state’s last users’ access to non -geograp­hical numbers, in an extent that technique and economically pos­sible in its own borders.
It must be supplied that when the subscribers demand the open public telephone services including mobile services subscribers, they must preserve their numbers ,independent from the service suppliers managements. However there are two main points, in accordance to this; first for geographical numbers users in a defi­nite place and for non geographical numbers all regional users must benefit from this service. In other words, although the por­tability of·non geographical numbers is valid for all regions; ge­ographical number portability can only be valid in a specific area. However, number portability service between the mentioned net­works can not be applied in networks that give service in a speci­fic area.
National organizing authorities must provide the cost based quatation of the intermediary connection which is related to num­ber portability and must supply that the costs which will be appli­ed to the subscribers must not be determined about using these type of oppurtunities.
National organizing authorities’ can not stipulate retail tariffs in a style that can damage the competition in number portability such as common or private retail tariffs.
